Privacy policy

Customer: any professional or natural person capable within the meaning of Articles 1123 et seq. of the French Civil Code, or legal entity, who visits the Website which is the subject of these general conditions.

Services: www.emi-wissler.com provides the Customers with :

  • Content: All the elements constituting the information present on the Website, in particular texts - images - videos.
  • Customer Information: Hereinafter referred to as "Information (s)" which corresponds to all personal data that may be held by www.emi-wissler.com for the management of customer relations and for analysis and statistical purposes.
  • User: Internet user connecting to and using the above-mentioned website.
  • Personal information: "Information that allows, in any form whatsoever, directly or indirectly, the identification of the natural persons to whom it applies" (article 4 of law n° 78-17 of 6 January 1978).
    The terms "personal data", "data subject", "processor" and "sensitive data" have the meaning defined by the General Data Protection Regulation (GDPR: No. 2016-679).
     

1. Management of personal data

The Customer is informed of the regulations concerning marketing communication, the law of 21 June 2014 for confidence in the Digital Economy, the Data Protection Act of 06 August 2004 as well as the General Data Protection Regulation (RGPD: n° 2016-679).
 

1.1 Persons responsible for the collection of personal data

For the Personal Data collected in the context of browsing the Website, the person responsible for processing the Personal Data is: Denis FOURNIER dpo@emi-wissler.com. EMI SAS is represented by Evelyne WISSLER, its legal representative.

As the party responsible for processing the data it collects, EMI SAS undertakes to comply with the legal provisions in force. In particular, it is its responsibility to inform the User of the purposes of the data processing, to provide its prospects and customers, from the time of collection of their consent, with full information on the processing of their personal data and to maintain a register of the processing in accordance with the reality. Whenever EMI SAS processes Personal Data, it shall take all reasonable steps to ensure the accuracy and relevance of the Personal Data with respect to the purposes for which EMI SAS processes it.
 

1.2 Purpose of the data collected

EMI SAS may process all or part of the data:

  • to enable browsing on the Website
  • to enable the processing of application requests and requests for information and offers
  • to prevent and combat computer fraud (spamming, hacking, etc.): computer equipment used for browsing, IP address, password (hashed)
  • to improve navigation on the Website: usage data
  • to carry out communication campaigns (email): email address

EMI SAS does not sell your personal data, which is therefore only used for statistical and analysis purposes.
 

1.3 Right of access, rectification and opposition

In accordance with the European regulations in force, the Users of www.emi-wissler.com have the following rights:

  • right of access (Article 15 RGPD) and rectification (Article 16 RGPD), updating, completeness of Users' data, right to block or erase Users' personal data (Article 17 RGPD), when they are inaccurate, incomplete, equivocal, outdated, or whose collection, use, communication or storage is prohibited

  • the right to portability of data provided by Users, where such data are subject to automated processing based on their consent or on a contract (Article 20 GDPR)
  • the right to define the fate of Users' data after their death and to choose to whom EMI SAS shall communicate (or not) their data to a third party that they have previously designated

As soon as EMI SAS becomes aware of the death of a User and in the absence of instructions from the User, EMI SAS undertakes to destroy the User's data, unless it is required to be kept for evidential purposes or to comply with a legal obligation.
If the User wishes to know how EMI SAS uses its Personal Data, asks to rectify them or objects to their processing, the User may contact EMI SAS in writing at the following address:

In this case, the User must indicate the Personal Data that he/she would like EMI SAS to correct, update or delete, identifying him/herself precisely with a copy of an identity document (identity card or passport).

Requests for deletion of Personal Data shall be subject to the obligations imposed on EMI SAS by law, in particular as regards the retention or archiving of documents. Finally, Users of www.emi-wissler.com may file a complaint with the supervisory authorities, and in particular with the CNIL (www.cnil.fr/fr/plaintes).
 

1.4 Non-disclosure of personal data

EMI SAS shall not process, host or transfer the Information collected on its Users to a country located outside the European Union or recognised as "non-adequate" by the European Commission without prior notice to the customer. However, EMI SAS remains free to choose its technical and commercial subcontractors provided that they present sufficient guarantees with regard to the requirements of the General Data Protection Regulation (RGPD: n° 2016-679).

EMI SAS undertakes to take all necessary precautions to preserve the security of the Information and in particular that it is not communicated to unauthorised persons. However, if an incident impacting the integrity or confidentiality of the Customer's Information is brought to the attention of EMI SAS, the latter shall inform the Customer as soon as possible and communicate the corrective measures taken. Furthermore, EMI SAS does not collect any "sensitive data".
The User's Personal Data may be processed by EMI SAS subsidiaries and subcontractors (service providers) exclusively in order to achieve the purposes of this policy.

Within the limits of their respective responsibilities and for the purposes mentioned above, the main persons likely to have access to the data of the Users of www.emi-wissler.com are mainly the agents of our customer service.
 

1.5 Types of data collected

Concerning the Users of the Website www.emi-wissler.com, we collect the following data which are essential to the functioning of the service, and which will be kept for a maximum period of 12 months after the end of the contractual relationship:

name, surname, company name, e-mail address, and telephone number. This is the case when you fill in the forms offered online, in the "careers" and "contact" sections.

EMI SAS also collects information to improve the user experience and to offer contextualised advice.
Concerning the use of the Website, such as the areas you visit and the services you access, your IP address, the type of browser you use, your access times.

This data is kept for a maximum period of 12 months after the end of the contractual relationship.
 

2. Notification of incidents

Despite our best efforts, no method of transmission over the Internet and no method of electronic storage is completely secure. We therefore cannot guarantee absolute security. If we become aware of a breach of security, we will notify affected Users so that they can take appropriate action. Our incident notification procedures take into account our legal obligations, whether at national or European level. We are committed to keeping our customers fully informed of all matters relating to the security of their account and to providing them with all the information necessary to help them meet their own regulatory reporting obligations.

No personal information of the User of the Website www.emi-wissler.com is published without the User's knowledge, exchanged, transferred, assigned or sold on any medium whatsoever to third parties. Only the assumption of the repurchase of EMI SAS and its rights would allow the transmission of said information to the eventual purchaser who would in turn be bound by the same obligation of conservation and modification of the data with respect to the User of the Website www.emi-wissler.com.
 

2.1 Security

To ensure the security and confidentiality of Personal Data and Personal Health Data, EMI SAS uses networks protected by standard devices such as firewalls, pseudonymisation, encryption and passwords.

When processing Personal Data, EMI SAS takes all reasonable steps to protect it from loss, misuse, unauthorized access, disclosure, alteration or destruction.
 

3. Liens hypertextes « cookies » et balises (“tags”) internet

However, EMI SAS is not in a position to check the content of the websites visited in this way, and consequently shall not be held liable for them.

3.1. « Cookies »

A "cookie" is a small information file sent to the User's browser and stored in the User's terminal (e.g. computer, smartphone), (hereinafter "Cookies"). This file includes information such as the User's domain name, the User's Internet service provider, the User's operating system and the date and time of access. Cookies are in no way likely to damage the User's terminal.

EMI SAS may process the User's information concerning his or her visit to the Website, such as the pages consulted and the searches carried out. This information enables EMI SAS to improve the content of the Website and the User's browsing.

Lastly, by clicking on the icons dedicated to the Linkedin, Vimeo and Youtube social networks appearing on the EMI SAS Website and if the User has accepted the deposit of cookies by continuing to browse the Website, Linkedin, Vimeo and Youtube may also deposit cookies on your terminals (computer, tablet, mobile phone).

These types of cookies are only deposited on your terminals if you consent to them, by continuing your navigation on the Website. However, at any time, the User may revoke his/her consent to EMI SAS depositing this type of cookie.
 

3.2. Internet tags

EMI SAS may occasionally employ Internet tags (also known as "tags", or action tags, single-pixel GIFs, clear GIFs, invisible GIFs and one-to-one GIFs) and deploy them through a web analytics partner that may be located (and therefore store the related information, including the User's IP address) in a foreign country.

These beacons are placed both in the online advertisements enabling Internet users to access the Website and on the various pages of the Website.

This technology enables EMI SAS to evaluate visitors' responses to the Website and the effectiveness of its actions (for example, the number of times a page is opened and the information consulted), as well as the use of the Website by the User.

The external service provider may collect information on visitors to the Site and other websites through these tags, compile reports on the activity of the Site for EMI SAS, and provide other services relating to the use of the Site and the Internet.
